Is Your OSHA Workplace Poster Prominently Displayed?

Each and every one of your workers is entitled to be informed of their rights under the Occupational Safety and Health Act. This takes the form of an OSHA workplace poster that is easy to obtain and easier to display. Compared to other laws, complying with this OSHA regulation is fairly straightforward. However, like all other OSHA regulations, an employer can receive severe penalties for failing to prominently display this poster in their workplace.

Below, our Texas OSHA defense attorneys discuss OSHA’s workplace poster, your requirements as an employer, and how you can avoid the steep penalties that have blindsided other contractors. If you’ve been accused of committing an OSHA violation, consult a Texas OSHA defense lawyer near you.

You Are Required to Display OSHA’s Workplace Poster

“Each employer shall post and keep posted a notice or notices, to be furnished by the Occupational Safety and Health Administration, U.S. Department of Labor, informing employees of the protections and obligations provided for in the Act.” As stipulated by 29 CFR 1903.2, this poster must be displayed at your business establishment in a conspicuous place where it can be seen by everyone, and each employee activity must be “treated as a separate physical establishment.”

Bottom line: you will need to prominently display a poster at every location your employees work at.

Where Can I Get an OSHA Workplace Poster?

Posters are provided by OSHA at no cost to you, and you can order by phone, order online, or download a copy from their website. OSHA also provides this poster in other languages, including Spanish, Chinese, and Portuguese. While there is currently no requirement to display this poster in a foreign language, such a poster could be a great benefit to your workers, and any steps taken to bridge the industry’s foreign language gap could be a boon to your company.

Penalties for Not Properly Displaying an OSHA Workplace Poster

Putting up an OSHA workplace poster couldn’t be simpler. It’s free. It’s readily available online, and once you have a poster up, there’s no need to replace it. This is juxtaposed by the severe penalties that are handed down to employers who violate posting requirements. The maximum fine is $13,260 per violation, and failure to correct this violation can result in a fine of $13,260 per day. As you can see, the simple act of forgetting to display a poster can result in serious penalties for your construction company.
