An OSHA compliance safety and health officer (CSHO) has just conducted an inspection of your job site and has passed on the findings to the OSHA director for an evaluation. Afterward, OSHA issues a Citation and Notice of Penalty. What happens next? This two-part series will help employers get a better understanding of what to do and what happens after an OSHA inspection. Read part two to learn more.
Correct the Violation
After the inspection, the compliance officer will inform you of your violation. You should address and correct the violations and any other safety hazards reported to you by the inspector. If you fail to address any of the unsafe conditions, you could receive a willful violation along with additional penalties.
Post the Citation
Following an inspection, and regardless of an intent to contest the citation, employers are required to post a copy of the citation at or near the site of the violation. This will ensure employees are aware that a hazard has been discovered. The citation should be posted for three days or until the violation is corrected.
Pay the Penalty
If you do not plan to contest the citation, be sure to pay all applicable penalties and abide by abatement requirements no more than 15 days after receiving the citation. If you need legal advice regarding penalties consult an OSHA defense lawyer can assist you. Failing to comply with abatement requirements could result in additional citations and penalties. Inquire about penalty reductions if you feel you have acted in good faith and have a good safety record.
